01 Agreement
By installing or using Voice Nimble (“Service”), including through the Shopify App Store, you (“Merchant,” “you,” or “your”) agree to be bound by these Terms of Service.
If you do not agree to these terms, you must not use the Service.
02 The Service
Voice Nimble is a software-as-a-service (SaaS) platform that uses AI to place and answer phone calls on behalf of your business.
The Service includes:
- AI-powered inbound and outbound calling
- Call automation and customer interaction handling
- Integration with your Shopify store
Billing is managed through the Shopify App Store on a recurring monthly basis.
03 Acceptable Use
You agree not to use Voice Nimble for any unlawful, harmful, or abusive activities, including:
- Calling individuals without proper consent
- Sending spam, scams, or misleading communications
- Harassment or abusive behavior
- Impersonating any person or business
- Circumventing Do-Not-Call (DNC) regulations
- Recording calls without required consent (where applicable)
- Violating any telecom, privacy, or data protection laws (e.g., TCPA, GDPR, CRTC)
You are solely responsible for obtaining proper consent from your customers before initiating or recording calls.
04 Your Account
- You must be the owner or an authorized user of the Shopify store where Voice Nimble is installed
- You are responsible for maintaining the confidentiality of your account credentials
- Any activity under your account is your responsibility
05 Subscription, Billing, and Refunds
- All plans are billed monthly via Shopify
- You may upgrade, downgrade, or cancel at any time
- Changes take effect at the end of the current billing cycle
- Usage limits (such as call minutes) reset each billing cycle and do not roll over
- Additional usage (overages) will be billed as per the pricing plan
- Refunds are not provided for partial billing periods unless required by law
06 Our Responsibilities
We are committed to:
- Providing a reliable service with a target uptime of 99.5%
- Informing you of significant changes to the Service
- Protecting your data and not selling your or your customers’ information
07 Limitation of Liability
Voice Nimble is provided “as is” without warranties of any kind.
We are not liable for:
- Missed or failed calls
- AI-generated errors or misunderstandings
- Indirect, incidental, or consequential damages
- Any losses exceeding the total amount paid by you in the past 12 months
08 Termination
We reserve the right to suspend or terminate your access to the Service if you violate these Terms, especially the Acceptable Use policy.
You may stop using the Service at any time by uninstalling or canceling your subscription.
09 Governing Law
These Terms are governed by the laws of Bangladesh. You agree to comply with all applicable laws in your jurisdiction.
If you use Voice Nimble through the Shopify App Store, Shopify’s terms and billing policies also apply.
Any disputes will be handled in the courts of Dhaka, Bangladesh, unless required otherwise by law.
